These terms and conditions apply to all proposals and service contracts of any nature between Magalgeoconsulting and the participants of the courses and consultancies provided by it, without exceptions. The use of services offered by Magalgeoconsulting implies the acceptance and agreement to the terms and conditions by the participant, which constitute a contract for the provision of training or consultancy services
2. Applicability
The implementation of this regulation and terms and conditions will take place within the scope of the commercial relationship established between Magalgeoconsulting and the participants at any stage of the registration procedure, either as the initially interested party or as the subsequent participant, whose acceptance of these terms and conditions will be recognized, tacitly or conclusively, freely, clearly and without reservations.
Failure to abide by any aspect of these terms and conditions will only be acceptable and will affect the parties when given written notice and signed by mutual agreement.
In the event of any omission to anything that has not been expressly agreed upon and contained within a written agreement, the provisions of these general conditions will always apply under any circumstances, and the interested party or participant may not claim their lack of awareness.
3. Enrollment in courses and consultancies
All those interested in the courses and consultancies provided by Magalgeoconsulting must formalize their registration by filling in the respective form available online on the Magalgeoconsulting website, which will be validated through an email confirmation.
A minimum number of interested parties must be registered in order for a Magalgeoconsulting course to take place. The confirmation of the respective course will be effected through e-mail by Magalgeoconsulting. Concomitantly, the respective invoices will be issued with all the necessary bank information and the amounts to be paid by the interested parties.
Interested parties will only be considered participants of the courses after proof of payment fees under the terms mentioned in the previous point. Participants will be confirmed by e-mail.
Considering that it is exclusively for Magalgeoconsulting to set the minimum and maximum limits for participants in each course, courses will only be carried out when the existence of the minimum number of participants is verified. Suppose the minimum number of participants in any course promoted by Magalgeoconsulting is not reached within seven working days before the scheduled start date. In that case, Magalgeoconsulting will be completely free to decide unilaterally to cancel it. This decision will be communicated via e-mail, and concomitantly, participants will be reimbursed for all amounts paid.
Suppose the number of participants in the courses taught by Magalgeoconsulting has not reached the maximum number previously defined. In that case, new participants may be accepted until the last working day before the start date of the respective course, in any case not exceeding the maximum number of participants previously fixed.
Notwithstanding the provisions of the preceding point, Magalgeoconsulting reserves the right to proceed with the constitution of new classes if the number of enrollments is greater than the maximum number of participants previously fixed for each course. In this case, interested parties will be registered on the waiting list and contacted by e-mail when a new class is proposed for that respective course.
If a participant withdraws from a course, the interested party registered on the waiting list will be contacted immediately, following the order of priority of the respective registration.
To provide a more efficient organization and planning of the courses offered by Magalgeoconsulting, enrollments in these courses must be made by interested parties up to twenty days before the published date of their realization.
In case of presencial courses, the location defined by Magalgeoconsulting will be previously informed via e-mail. Because of the occurrence of circumstances beyond your control, Magalgeoconsulting may change the location previously indicated twenty-four hours in advance to another site and facilities with similar characteristics and located in the same city. This change will also be communicated by e-mail.
When conducting courses involving the presence of participants, Magalgeoconsulting does not assume any commitment or responsibility for making hotel, air travel, or any other reservations on behalf of participants travelling to the place where said course comes to be taught. It is recommended that participants do not proceed to pre-paid accommodation or transportation tickets until the course in question is confirmed by Magalgeoconsulting in terms explained above.
To participate in field courses, it is necessary to present a medical certificate assuring that the participant is in good health and in adequate physical condition for the course activities in the classroom and outdoors, such as walking on uneven floors and exposure to the weather. The use of appropriate footwear is recommended, such as sneakers or boots, long pants and protection from the sun (hat, sunglasses, among others).
4. Cancellations, refunds and replacements
Participants in courses offered by Magalgeoconsulting will be able to cancel their enrollment within fourteen (14) days after confirmation of the same - exercise of the right to repent under the terms defined in European Union law concerning contracts concluded through digital platforms, without the need to present any justification - or, after the deadline for exercising the right of repentance has expired, up to seven (7) working days before the date designated for the beginning of the course in question. In any case, the participant must send the respective communication by e-mail to Magalgeoconsulting.
Participants who request cancellation of their participation within the period for exercising the right of repentance will be refunded within forty-eight (48) hours of the amount paid in full and related to the price of the course in question. For this purpose, the participant must provide all the necessary bank information.
Participants who request the cancellation of their participation via email within up to seven (7) working days before the date designated for the beginning of the course in question, will be refunded within forty-eight (48) hours of the amount paid, minus the amount corresponding to 20% by way of administrative expenses. For this purpose, the participant must provide all the necessary bank information.
In any of the cases mentioned in the preceding points, participants who request to cancel their registration via email can choose to keep credits in the amounts they have paid for any courses that Magalgeoconsulting offers that they may wish to take in the future. The credit will have a validity of one year from the date of the reference cancellation request.
The participant of a course may appoint any other person to replace him/her, provided that the participant communicates this change to Magalgeoconsulting via email at least forty-eight (48) hours in advance of the course, and provides all the elements of identification and contact information for the nominated substitute.
Outside the scope of the assumptions above, Magalgeoconsulting is not obliged to return/refund any amounts settled.
Failure to register the minimum number of participants;
Situation of illness duly confirmed by the instructor or by his immediate family - children, spouse or parents and in-laws - or other similar situations;
Occurrence of logistical problems that make the course in reference irreversible;
Occurrence of unpredictable and force majeure unusual events that Magalgeoconsulting has not caused, nor can be attributed to.
In these cases, Magalgeoconsulting will inform participants of the course's cancellation via e-mail and request the necessary bank information to provide reimbursement to all participants. Course cancellations will also be informed on the Magalgeoconsulting website so that, from this oment on, no new registrations are made.
5. Teaching material and attendance certificates
The fixed price for participation in any course taught by Magalgeoconsulting includes all material necessary for the participant. The material will be sent via email to each participant the week before the course in question starts. The participant is responsible for providing the necessary technical and computer resources for this purpose, namely, computer and internet access, that allows his/her participation in any of the courses taught by Magalgeoconsulting.
After completing the course in question, Magalgeoconsulting will send a certificate of participation to each participant who satisfactorily completes the course and who has attended at least two-thirds of the course period highlighted.
All intellectual property rights related to courses taught by Magalgeoconsulting and the technical and scientific information and knowledge transmitted by the respective instructors, are the exclusive property of Magalgeoconsulting, even if shared with participants in writing, adapted, or formatted for the use of the participants throughout the duration of the course.
Participants are not allowed to copy, modify, reproduce, republish, subcontract, sell, transmit or distribute by any means of communication in all or parts of the material produced by Magalgeoconsulting. Participants are not allowed to proceed to video recording or audio by any means of the subjects taught in the courses, carried out through digital platforms, without prior express written authorization from Magalgeoconsulting, or its instructors.
During the courses delivered through digital or similar platforms, Magalgeoconsulting provides a limited, personal and non-transferable license for the exclusive use of the participant, relating to the materials and software of the highlighted courses.
Between Magalgeoconsulting and the participants, it is agreed in advance that all information related to the courses it teaches, the enrollment procedures, and the entire process of attending the predicted services, are considered confidential under this Regulation and Terms and Conditions. The confidentiality will be maintained after the completion of the training services provided by Magalgeoconsulting.
6. Exclusion of liability
Any liability on Magalgeoconsulting and its instructors for erroneous assimilation or perception of technical-scientific information provided during the courses and consultancies given is considered excluded, as well as relating to circumstances arising from the violation of this regulation.
The incipient, deficient or imprudent use of the technical-scientific knowledge provided by Magalgeoconsulting, acquired by the participants in the exercise of their professional activities, will always be their exclusive responsibility. Magalgeoconsulting cannot be held responsible in any way.
7. Privacy policy – data protection
Magalgeoconsulting is bound to the strict compliance with the current Portuguese legislation, granted to protect personal data, which is responsible for safeguarding the personal information provided by interested parties and participants in the various phases involved in the realization of courses and consultancies supplied. This information will only be used internally by Magalgeoconsulting and will not be provided in any way to third parties, being guaranteed the right of access of interested parties and participants to their data and rectification, and also to the right of opposition and oblivion, whenever, demonstrably, it is justified and legally admissible.
8. Applicable legislation and competent jurisdiction
Any conflicts that arise concerning the conclusion, content and fulfilment / non-fulfilment of the contracts agreed between Magalgeoconsulting and the participants within the scope of the courses and consultancies provided by Magalgeoconsulting will apply to Portuguese law and the competent Court will be, to the exclusion of any other, the Judicial Court of the District of Lisboa Oeste - Cascais.
9. Communications
Any communication of any nature and of any purpose established between Magalgeoconsulting and the interested parties and participants will preferably be via e-mail. The content of these always prevailing over any other communications that may have been between the parties mentioned above.
